GENERAL TERMS AND CONDITIONS
Article 1 – Definitions
In these conditions, the following definitions apply:

Withdrawal period: the period within which the consumer may exercise the right of withdrawal;

Consumer: a natural person who is not acting for purposes relating to trade, business, craft or profession, and who enters into a distance contract with the trader;

Day: a calendar day;

Long-term contract: a distance contract relating to a series of products and/or services, where the supply and/or acceptance obligation is spread over time;

Durable medium: any tool that enables the consumer or the trader to store information addressed personally to them in a way that allows future consultation and unaltered reproduction of the stored information;

Right of withdrawal: the consumer’s option to withdraw from the distance contract within the cooling-off period;

Trader: a natural or legal person who offers products and/or services remotely to consumers;

Distance contract: a contract concluded within the framework of a system organised by the trader for the distance sale of products and/or services, whereby only one or more techniques for distance communication are used up to and including the conclusion of the contract;

Technique for distance communication: means that can be used to conclude a contract without the consumer and trader being in the same place at the same time;

Article 3 – Applicability
These general terms and conditions apply to all offers by the trader, to all distance contracts concluded, and to all orders placed between the trader and the consumer.
The consumer must have access to these terms before the conclusion of a distance contract. Upon request, they will be provided free of charge. If the contract is concluded electronically, the terms will also be made electronically available in a way the consumer can easily store them on a durable medium.
In case of conflicts between these terms and specific product/service conditions, the more favourable provision for the consumer shall apply.
If any provision becomes invalid, it shall be replaced by a valid one reflecting the original intent.
Any ambiguities or situations not regulated must be interpreted “in the spirit” of these terms.
Article 4 – Offers

If an offer has a limited validity period or is subject to conditions, this will be explicitly stated.

The offer is non-binding.

Product descriptions are accurate and detailed, with images that faithfully represent the product.

Errors in the offer do not bind the trader.
-
Product photos aim to represent the product but colour variations cannot be guaranteed.
The offer must clearly state:
-
that import duties and VAT on imports are not included and are at the customer’s expense;
-
shipping costs;
-
how the contract is concluded;
-
right of withdrawal (if applicable);
-
payment, delivery, and execution methods;
-
validity of the price;
-
applicable communication costs;
-
archiving conditions;
-
correction possibilities for consumer-provided data;
-
available languages;
-
applicable codes of conduct;
-
minimum contract duration for continuous transactions.
Article 5 – The Contract
The contract is concluded when the consumer accepts the offer and meets its conditions.
For electronic contracts, the trader confirms receipt of acceptance and ensures secure data transmission.
The trader may verify the consumer’s ability to fulfil payment obligations and, based on findings, may refuse or impose special conditions.
Upon delivery, the trader provides:

their business address for complaints,
-
withdrawal rights (or exclusions),
-
warranty details,
-
termination conditions (if applicable).
Contracts are subject to product availability.
Article 6 – Right of Withdrawal
Consumers may withdraw within 14 days after receiving goods.
During this period, the consumer must handle products carefully, only inspecting them as necessary. Returns must include accessories and, if possible, original packaging.
Withdrawal must be notified within 14 days, followed by returning the product within another 14 days.
If deadlines are not met, the contract is binding.
Article 7 – Costs in Case of Withdrawal
Return shipping costs are borne by the consumer.
Refunds (including initial payments) will be made within 14 days, provided the trader has received the return or proof thereof.
Article 8 – Exclusions from Withdrawal
The right of withdrawal does not apply to products:
-
made to consumer specifications,
-
of a personal nature,
-
non-returnable due to nature,
-
perishable,
-
with price fluctuations beyond the trader’s control,
-
newspapers/magazines,
-
unsealed audio/video recordings or software,
-
hygienic products with broken seals.
For services:
-
accommodation, transport, catering, leisure at a specific date,
-
services started with consumer consent before cooling-off ended,
-
bets/lotteries.
Article 9 – Prices
Prices remain stable during the offer period, except for VAT changes.
Price increases within 3 months are allowed only if legally required. After 3 months, increases may apply if agreed in advance.
Import duties and VAT for EU destinations are borne by the consumer.
Misprints or typographical errors do not bind the trader.
Article 10 – Conformity and Warranty
The trader guarantees conformity with the contract, specifications, and reasonable quality standards.
Warranty claims must be made in writing within 14 days of delivery.
Warranty corresponds to the manufacturer’s warranty.
Exclusions apply if:

consumer misused or modified products,
-
products exposed to abnormal conditions,
-
defects result from materials required by consumer.
Article 11 – Delivery and Execution
Orders are executed with care. Delivery is within 30 days, unless otherwise agreed.
If delayed, the consumer may cancel and receive a refund within 14 days.
If replacement products are delivered, withdrawal rights remain.
Risk passes to consumer upon delivery.
Article 12 – Duration Transactions, Termination, Renewal

Consumers may terminate indefinite contracts at any time with max 1-month notice.

Fixed-term contracts cannot auto-renew indefinitely. Limited renewal (e.g., up to 3 months) is possible for newspapers/magazines.

Contracts longer than 1 year can be terminated after 1 year with 1-month notice.
Article 13 – Payment
Payments must be made within 7 days of the withdrawal period start.
Consumers must report errors in payment details immediately.
Non-payment may incur lawful charges.
Article 14 – Complaints Procedure
Complaints must be submitted within 7 days of discovery, clearly described.
Responses will be given within 14 days. If more time is needed, the trader informs the consumer.
Unresolved disputes may proceed to dispute resolution.
A valid complaint entitles consumer to replacement or repair.
Article 15 – Disputes
Dutch law applies exclusively, regardless of the consumer’s residence.
Article 16 – CESOP
In line with the 2024 amendment to the VAT Act and the introduction of the Central Electronic Payment Information System (CESOP), payment service providers are required to register payment data in the European CESOP system.
Note: We do not have a physical office in Poland. Orders are shipped directly from Asia. For returns, products must be sent back to our foreign warehouse at the customer’s expense.
